If the probability of being caught using performance enhancing drugs is low many athletes will use them unless they face criminal sanctions. Let’s say an athletic association such as MLB required players to sign a contract which called for a player to receive five years in prison if he tested positive for steroids. If MLB would reimburse the state for the cost of prison, do you believe that the government should enforce this contract?
